Terms of Service

1. Acceptance of Terms
By creating an account, accessing, or using Xplorr (including our mobile apps, websites, and services) you agree to these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use Xplorr.
Consent record. When you sign up, we may store the Terms/Policy version you accepted and a timestamp (and your IP/country, where required by law) so we can demonstrate consent.
2. Eligibility & Accounts
You must be at least 13 years old (or older if your local law requires) to use Xplorr. If you are under 18, you must have permission from a parent or legal guardian.
You must provide accurate information and keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
We may refuse, suspend, or terminate accounts that violate these Terms or our Community Guidelines.
3. Usernames – Permanent Lock & Limited Changes
Usernames are unique identifiers. When you claim a username, it becomes permanently locked to your account history and will not be reassigned to others, including after a change.
You may change your username up to five (5) times over the lifetime of your account. Each new username you claim is permanently locked and cannot be reused by others.
You may not impersonate others, violate trademarks, or choose names that are offensive or infringe rights.
4. User Content & License to Xplorr
You own your content. You retain rights in photos, videos, text, and other content you post ("User Content").
By posting, you grant Xplorr a worldwide, non‑exclusive, royalty‑free, sublicensable, transferable license to host, store, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform and display your User Content solely for operating, improving, and promoting Xplorr (e.g., displaying posts, resizing media, promoting features, or training moderation systems). This license ends when you delete your content, except where: (a) your content was shared with others who have not deleted it; (b) it is kept for a limited period for legitimate business/legal purposes (e.g., backup, fraud prevention, dispute resolution).
You represent that you have all rights necessary to grant this license and that your content complies with these Terms.
5. Public Nature of Content
Posts you mark as public (or in public areas of Xplorr) may be viewable by anyone, on or off Xplorr, and may be indexed by search engines. You are responsible for what you share.
6. Prohibited Conduct & Content
You agree not to:
- Violate any law or third‑party rights, including IP rights and privacy rights.
- Post unlawful, defamatory, obscene, sexually explicit, exploitative, hateful, harassing, or violent content, or content that promotes self‑harm or dangerous activities.
- Engage in fraud, phishing, spam, or scams; interfere with or disrupt the Service; use automated means without permission; or reverse engineer.
- Upload viruses, malware, or other harmful code.
- Stalk, harass, or dox other users; or attempt to access another user's account.
- Post confidential or personal data of others without permission.
7. Community & Safety
We may remove or restrict content or accounts to protect users, comply with law, or enforce policies.
You can report content or users through in‑app tools. We may, but are not obligated to, monitor content or activity.
8. Travel & Third‑Party Services; Bookings & Links
Xplorr may display listings, prices, or availability from third‑party travel providers (e.g., flights, hotels, experiences) via APIs or affiliate networks. Xplorr is not a travel agency and is not a party to any third‑party booking. Bookings are governed by the provider's terms, privacy policies, fees, and rules.
AI Planner. Xplorr's Plan feature uses AI and third‑party data sources to suggest itineraries (e.g., flights, hotels, restaurants, activities). These are recommendations only. Prices, availability, and travel requirements change frequently and may differ from what the provider ultimately offers. Always review the provider's details before booking.
Affiliate relationships & compensation. We may receive commissions, referral fees, or other incentives for bookings or purchases made via links or integrations in Xplorr. This does not increase the price you pay with the provider, but providers may compensate us for successful referrals.
Some features may redirect you to third‑party sites or apps. Your use of third‑party services is at your own risk. Xplorr does not control and is not responsible for third‑party content, policies, or errors.
9. AR/Geo‑Features & Safety Notices
Xplorr includes maps, AR overlays, and location‑based features. You can also post content that reveals your physical location (e.g., geotagged photos, visible landmarks) and attach QR codes other users can scan to navigate to the same spot. Only share location information you are comfortable making public.
Location disclosures may persist in screenshots, re‑shares, or third‑party caches even if you later delete content. Remove EXIF/geotags before upload if you don't want them shared; avoid posting QR codes or close‑up landmarks if you do not wish to disclose precise locations.
Always follow local laws, posted signs, and respect private property and sensitive areas (e.g., stadium fields, restricted zones, wilderness closures, wildlife protections). You are solely responsible for your safety; do not trespass or engage in risky activities to interact with app features.
10. In‑App Purchases & Subscriptions
Paid features (e.g., subscriptions) are billed by Apple/Google or our payment providers. Prices may change with notice as required by law. Some purchases may be non‑refundable as permitted by law and platform policies.
10A. Advertising & Monetization
Xplorr may show advertisements, including interest‑based ads, and may use identifiers (e.g., device/app identifiers) to measure ad performance and tailor content, subject to your platform permissions (e.g., Apple's App Tracking Transparency) and applicable laws.
You may see sponsored or paid content. Where required, we will label sponsored placements.
We participate in affiliate/partner programs and may receive compensation when you click links or complete purchases/bookings with partners. See the Privacy Policy for details on data sharing and your choices.
We may expand revenue‑generating features over time (e.g., new ad formats, premium features). We will update these Terms/Policy and, where required, request new consent.
11. Intellectual Property; DMCA
Xplorr and our licensors own all rights in the Service (software, logos, trademarks, etc.). You may not use our IP without permission.
DMCA Agent: If you believe content infringes your copyright, email JRogers@xplorr.live with: (1) your contact info; (2) identification of the work; (3) identification of infringing material; (4) a statement under penalty of perjury; (5) your signature. We may notify the user and act per the DMCA.
12. Feedback
If you submit feedback or ideas, you grant Xplorr a perpetual, irrevocable, worldwide, royalty‑free right to use them without restriction or compensation.
13. Disclaimers
The service is provided "as is" and "as available." To the maximum extent permitted by law, Xplorr disclaims all warranties, express or implied, including fitness for a particular purpose, title, and non‑infringement. We do not warrant that the service will be uninterrupted or error‑free.
14. Limitation of Liability
To the maximum extent permitted by law, Xplorr and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, use, or goodwill, arising from or relating to your use of the service. Our aggregate liability for all claims relating to the service shall not exceed the greater of US$100 or the amounts you paid to Xplorr in the 12 months before the claim.
15. Indemnification
You agree to defend, indemnify, and hold harmless Xplorr from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service or your violation of these Terms.
16. Termination
We may suspend or terminate your account or access at any time for any reason, including policy violations. You may stop using the Service at any time. Certain provisions survive termination (e.g., licenses, limitations of liability).
17. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles. You agree to the exclusive jurisdiction of state and federal courts located in Delaware for any disputes not subject to arbitration. We may introduce an arbitration program in future versions of these Terms.
18. Changes to Terms
We may update these Terms from time to time. We will post the new Terms and update the "Effective date." If you continue using the Service after changes, you accept the updated Terms.
